In Schools
  • Opt-In Policy:

Starting with the 2025-2026 school year, parents must provide consent before their child can be subjected to corporal punishment.

  • What is Allowed:

The Florida Department of Education defines it as the moderate use of physical force for discipline.

  • Parental Consent:

The new law, HB 1255, allows parents to either give consent for the entire school year or approve each instance of punishment.

  • District Responsibility:
School districts that allow corporal punishment must have formal policies and provide parental consent forms.

For schools, recent legislation (HB 1255, effective 2025-2026) requires parental consent before corporal punishment can be administered, shifting from notification to a mandatory opt-in system. In either context, actions causing injury, such as bruises, welts, or striking with an object, can lead to child abuse charges.

In the Home
    • Permissible:

Reasonable, moderate, and non-excessive corporal punishment is legally allowed.

    • Examples:

A traditional spanking with an open hand on the buttocks is generally considered acceptable.

  • Prohibited:

Hitting with objects (like belts or sticks), inflicting marks like bruises or welts, or striking the face or head are unacceptable and can be classified as abuse.

  • Legal Defense:
Parents can use the parental privilege to use reasonable corporal punishment as an affirmative defense against child abuse charges

  1. It’s about time! Hopefully this will spread to other states, as well. MAYBE some of these kids will get the hint that THEY ARE NOT IN CONTROL AND ENTITLEMENT DOESN’T WORK FOR THEM!! When I was growing up,, if I got in trouble at school, I got in trouble at home, too. Giving back control to teachers is an absolute must.
