DEERFIELD BEACH BASED USEDTIRES.COM AND COD TIRE DISTRIBUTORS OF MAYAGUEZ TO SUE TIRE MAKERS

Deerfield-News. com-Deerfield Beach,Fl-Usedtires.com and C.O.D.Tire distributors of Mayaguez, Puerto Rico, have retained counsel and will proceed shortly to file a Class Action Lawsuit against major tire makers, Goodyear, Bridgestone-Firestone, Michelin, and Pirelli. The suit may bring in other Tire Makers who also belong to the Trade Industry Association known as USTMA.

Usedtires.com and C.O.D Tire Distributors have again selected Nachman and Guillemard in San Juan to be the lead counsel in this “Class Action” lawsuit.

There is once again legislation pending in Puerto Rico that will damage all sellers of used tires on the island and elsewhere if not challenged.

UsedTires.com, based in Deerfield Beach, has been selling new and used tires since 1981. C.O.D. Tire Distributors has also been a tire dealership, selling new and used tires in Puerto Rico, since the 1980s. Together, they were partners in another Deerfield Beach-based tire company, Used Tire International Inc.

Used Tire International sold used tires worldwide to customers throughout Central America, South America, and the Caribbean.

Both South Florida and Puerto Rico were their bases of operation.

In 1996, Used Tire International sued the government of Puerto Rico, successfully challenging Law 171 of 1996 on constitutional grounds. To this day, the Permanent Injunction is in effect, allowing for the “unfettered importation” of Used Tires into Puerto Rico.

Once again, we allege that at least the four “Tire Makers” named above are behind the new proposed legislation in Puerto Rico. USTMA has also introduced legislation in several states, some of which have been adopted.

Both companies, along with their customers and any other used tire dealers, may participate in this class action. This could result in thousands or tens of thousands of plaintiffs versus “The Tire Makers”.

Approximately 300 million new tires are sold in the United States each year. It is estimated that 38-40 million used tires are culled, sorted, and inspected, generating a huge market for used tires.

For the better part of 30-plus years, the new Tire Makers have, we believe, broken several laws and defamed and injured the used tire industry.

When USTMA “lobbies” and I used that word loosely, or writes the “Bills” that get introduced into whatever state or U.S territory legislative body, we believe it to be unlawful and anti-competitive. We have instructed our counsel to protect our rights and sue for damages caused by the new tire makers to used tire dealers.
