President Trump and other federal government agencies have been sued in federal court.

A complete copy of the complaint is not yet publicly available online, as CNN, MS NOW (formerly MSNBC), and Politico filed a joint lawsuit today, September 21, 2026, in the U.S. District Court for the District of Columbia.
However, the legal framework and immediate details of their requested Temporary Restraining Order (TRO) and Preliminary Injunction have been made public through their joint statements and initial legal reporting:
  • First Amendment Retaliation & Viewpoint Discrimination: The suit alleges the administration violated the First Amendment by retaliating against protected newsgathering. It argues the government cannot selectively strip access to public resources or nonpublic forums (like the White House press area) based on whether it dislikes an outlet’s viewpoint or reporting.

  • Fifth Amendment Due Process Violation: The complaint highlights that the White House abruptly deactivated the reporters’ press passes without advance notice, clear standards, or any administrative opportunity to be heard before barring them from entry.

  • Irreparable Harm (The Basis for the TRO): To obtain an immediate temporary restraining order, the outlets argue that every day their White House correspondents (Betsy Klein of CNN, Akayla Gardner of MS NOW, and Cheyenne Haslett of Politico) are blocked from physical newsgathering creates irreversible constitutional harm and a chilling effect on press freedom.

Below are the four requirements a plaintiff must demonstrate in order for a TRO to issue. After a TRO if granted a hearing will be held. Both parties at that time will be able to make oral arguments and have witnesses testify .Again, if Plaintiffs prevail, they will be granted a Preliminary Injunction, and the next phase will be a trial to obtain a Permanent Injunction.

To get a preliminary injunction or temporary restraining order, a person must generally prove four key elements. [1, 2]
    • Likelihood of Success on the Merits: You must show that you have a good chance of winning the main lawsuit when it goes to trial.
  • Irreparable Harm: You must prove that you will suffer a serious injury that cannot be fixed with money or standard financial damages.

  • Balance of Equities (Hardships): The judge will compare your harm if the order is denied against the harm the defendant will face if the order is granted. Your harm must be greater.

  • Public Interest: You must show that the court order will not harm the general public or go against public policy
