IF SHERIFF TONY ORDERS CAPTAIN HOFFSTEIN TO ELIMINATE POLICE SERVICE ON AUGUST 1 IT WOULD BE AN UNLAWFUL ORDER

Deerfield-News. com-Deerfield Beach, FL-If the Sheriff sticks to the words he has said on social media and in flyers mailed to Deerfield Beach residents, it would be an unlawful order.He would put an excellent, dedicated BSO Captain in a legal quagmire. I take the Sheriff at his word. I believe Deerfield Beach will be seeking a Temporary Restraining Order from the Broward County Circuit Court sooner rather than later, as the Sheriff has been clear in his intentions. I do not believe, nor does my personal attorney, that filing for injunctive relief prior to August 1 is anticipatory, as the Sheriff has made his intentions absolutely clear.

If the court were to find that Deerfield Beach seeks injunctive relief barring the Sheriff from providing either police or fire services prior to August 1 and it is premature, the city will simply refile on August 1.

I do not understand the Sheriff’s campaign and its fear-and-scare tactics; that is what it is. The city has made its choice; there is no going back

Deerfield Beach will have a police and fire rescue department.

I do know that a Sheriff who claims to be the most powerful man in Broward County should know better and do better. I voted for Sheriff Tony twice. If I could take those votes back, I would.

Putting a dedicated Captain who has served both BSO and Deerfield Beach well and honorably in a position to follow an unlawful order is something no Florida Sheriff should do.

I have no doubt that, whether it be prior to August 1 or on August 1, the city of Deerfield Beach will be granted Injunctive Relief, and the court will order Sheriff Tony to provide uninterrupted police and fire services to Deerfield Beach.

Those who understand there are 4 requirements to get a Temporary Restraining Order and then a Preliminary Injunction. The 2 most important are irreparable harm and the likelihood of success on the merits; Deerfield has those and the other 2 needed.
