Deerfield-News. com-Deerfield Beach, Fl-In our continuing story of settled lawsuits and pending lawsuits against the city of Deerfield Beach, today we received the list. In what became a request for public records that received a response that a minimum of 8 hours would be required for the city attorney to produce the documents. Yesterday Deerfield-News.com clarified what information we were seeking. Seems that when I requested the following “Please send all public records pertaining to open/pending lawsuits against the city of
Deerfield Beach the title, the case numbers and court where the actions are pending”

The city attorney has provided the list below of pending lawsuits. The city attorney also will obtain and forward to us the pending Workers Compensation claims pending which are handled by outside counsel.

List of Pending Lawsuits.pdf
Good afternoon City Clerk’s office. Please provide for the following below and attached to be
uploaded to JustFoia and provided to the requestor. Thank you.
I have been asked to respond Mr. Levy’s email communication concerning a recent record request
he submitted to the City of Deerfield Beach regarding pending litigation against the City. Specifically,
the public record request that was previously forwarded to my office from the City Clerk’s Office
asked for the following:
“Please send all public records pertaining to open/pending lawsuits against the city of
Deerfield Beach the title, the case numbers and court where the actions are pending”
The request for “all public records” pertaining to pending litigation against the City would require my
office to compile a considerable amount of records and correspondences for each pending case and
redact any litigation strategy/mental impressions, etc. that are exempt from public inspection
pursuant to Chapter 119, Florida Statutes. This would require extensive use of IT resources and
personnel time, which is why a time and cost estimate was provided as permitted by Chapter 119,
Fla. Stat.
Based on Mr. Levy’s email communication from yesterday (copied below), he has narrowed his
request to a list of cases against the City that are in pending litigation (case style, parties, case
number). That can be provided without extensive use of IT resources and personnel. I have
provided the attached in response to his November 30 public records request.
Note that the attached does not include a list of workers compensation cases that are handled by
outside counsel through the City’s third party administrator. The City’s risk management
department has requested the information from the third party administrator and should have the
information to supplement the attached in the next day or so.

Hello Samantha,
I think we have got 14995 with 14994 confused. I am not looking for the lawsuits
settled I have received that. Seems it is my error from an email I sent to Rebecca as
far as how many hours the city wanted to charge I will correct my posts.
That said
The lawsuits and case numbers of pending litigation is what I am seeking. How many
cases can be pending that it would even take 8 hours to list? Certainly, the city
attorney knows how many cases are pending and must have a list with the case
numbers.? Simply asking for the case style name of plaintiff or defendants and the
case numbers.
Thanks,
Howie
