WE STILL WANT THOSE PUBLIC RECORDS OF CURRENT LAWSUITS PENDING AGAINST THE CITY

Deerfield-News. com-Deerfield Beach, Fl-As we have previously published the recently settled lawsuits against Deerfield Beach. Deerfield-New.com has requested the pending cases and their case numbers and style of the cases from the city. The city attorney is claiming that would require at least 8 hours of time to gather and thus makes it cost-prohibitive for Deerfield-News.com  to pay them for 8 hours of labor.

The response from the city attorney is bullshit and we call them out on it. There is no way it could take 8hours for a law firm to list its pending cases in a city the size of Deerfield Beach.  How many cases can be pending that the city attorney wants the city to charge us for 8 hours of labor? What are they hiding? We eventually will get these records with the help of another news organization that can and will pay this ridiculous request or we will hire attorneys to seek a Mandamus.

Put me in the room with the documents you claim will take 8 hours to list and I will do the work for you. The law requires you to produce these documents, Mayor Ganz is on the record stating public records requests should not be cost-prohibitive, but the city attorneys are making it so in this case.

119.01 General state policy on public records.

(1) It is the policy of this state that all state, county, and municipal records are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency.
(2)(a) Automation of public records must not erode the right of access to those records. As each agency increases its use of and dependence on electronic recordkeeping, each agency must provide reasonable public access to records electronically maintained and must ensure that exempt or confidential records are not disclosed except as otherwise permitted by law.

 

(12) “Public records” means all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency.
