OUR TAKE- NIMBY COUNTY FAILS RESIDENTS WITH DUMP EXPANSION

That is the position that our County Commissioners have put local residents in. I am not sure what all the options are including constructing a new landfill out in the western part of Broward County. Waste Management has a monopoly on receiving garbage locally and collecting “Tipping Fees from the waste generator.

I read that some readers were suggesting sending garbage generated in Broward or wherever that would go to Waste Management by train to other landfills in Okeechobee County. There is nothing stopping anyone including Waste Management from sending garbage out of state either. The Dormant Commerce Clause of the U.S. Constitution has a litany of case law on this subject including a case I and my partner brought against Puerto Rico when they tried to ban the importation of used tires to protect their landfill space. No matter how laudable the cause the courts have ruled time and again garbage can not be banned between the states only based on origin. Many in the scrap tire business locally send whole scrap tires generated here in Florida to Alabama landfills as they still accept whole tires and they make money doing it.

Below is our case against Puerto Rico which is directly on point about garbage and a state or in this case U.S. territory trying to restrict a product that will eventually wind up in a landfill.
