Deerfield-News.com-Deerfield Beach,Fl-In our recent post about Deerfield Beach’s back-up water treatment plant we posted a resolution,a unilateral document Deerfield Beach passed and sent to us in a record request.Readers have emailed to see if there was a formal plan or another document from Boca Raton ratifying Deeerfield’s proclamation.Deerfield-News.com made a public records request to the City of Boca Raton and here is what they sent.This does in fact show a mutual agreement that in case of an emergency either city can by “use of a valve” use the other cities water.The agreement in article 4 shows the informal way in which each city may obtain emergency water from the other.The agreement from January of 1983 has been recorded in both the circuit court of Palm Beach county and the circuit court of Broward county.

A ~RESOLUTION OF THE CITY OF BOCA RATON
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT WITH THE CITY OF
DEERF IELD BEACH FOR THE PURPOSE OF PRO-
VIDING EMERGENCY WATER BETWEEN THE CITY
OF BOCA RATON AND THE CITY OF DEERFIELD
BEACH
WHEREAS, the City of Boca Raton has found it desirable
to enter into an agreement with the City of Deerfield Beach for
the purpose of providing emergency water between the City of
Boca Raton and the City of Deerfield Beach; and
WHEREAS, such agreement has been prepared and a
copy
thereof is attached hereto;. now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOCA RATON:
Section 1. That the Mayor and City Clerk be authorized
to execute the agreement with the City of Deerfield Beach, a
copy of which is attached hereto.
Section 2. This resolution shall take effect immediately
upon adoption.
PASSED AND ADOPTED by the City Council of the City of
Boca Raton this 11th day of January~ 1983.

EMERGENCY AGREEMENT
CITY OF BOCA: RATON
AND
CITY OF ‘ DEERFIELD BEACH’
THIS AGREEMENT by and between the CITY OF / BOCA RATON, a
Florida municipal corporation, hereinafter referred to as ” BOCA
RATON”, and. the CITY OF’ DEERFIELD BEACH, a Florida municipal corporation,
hereinafter referred to as ” DEERFIELD BEACH.”
WHEREAS, DEERFIELD BEACH and BOCA RATON have water lines
in close proximity to each other east of the Intracoastal Waterway;
WHEREAS, DEERFIELD BEACH and BOCA RATON desire to guard
against the potential danger” of failure’ of water service to customers
within their service area~; and
WHEREAS, DEERFIELD BEACH and BOCA RATON desire to address
their mutual connection’ by entering into this inter1ocal agreerment,
pUrsuant to Section 163. 01, Florida Statutes;
NOW, THEREFORE, in consideration of the mutua1 promises
contained herein, DEERFIELD BEACH. and BOCA RATON agree as follows:
L DEERFIELD BEACH will connect . their water system to
the water system of BOCA RATON in~ accordance with mutually agreeable
~ specifications.
2. DEERFIELD BEACH and BOCA RATON will equally share the
cost of such connection. payment~ shall be coordinated through the
respective Finance Departments of DEERFIELD BEACH and BOCA RATON.
3. The connection ~,will be controlled by bvo valves, one
of which \ wi11 be operable by DEERFIELD BEACH and one of which is
operable, by BOCA RATON.
4. In the event of a water system fai1ure, causing an
emergency in either DEERFIELD BEACH\ or BOCA RATON, the valve of the
party not expriencing the emergency will be opened so as to permit
the flow. of water to the party experiencing the emergency.
